Bot@Work Acceptable Usage Policy

1. Purpose. The purpose of this Bot@Work Acceptable Use Policy (“Acceptable Use Policy”) is to ensure ethical, responsible and lawful use of the Services provided by FWS. If any capitalized word or phrase has been defined within the Terms of Service, available at https://ai.botatwork.com/legal/terms but has not been defined within this Acceptable Use Policy, that word or phrase shall have the same meaning that has been assigned to it under the Terms of Service.

2. Applicability. The Acceptable Use Policy is applicable to everyone who visits, and/or uses FWS’ Services.

3. Compliance with Applicable Laws and FWS’ Policies. If your usage requires compliance with specific laws such as the General Data Protection Regulation, Health Insurance Portability and Accountability Act, or the Children's Online Privacy Protection Act, you must obtain prior written consent from FWS for such usage, subject to execution of additional agreement(s) for such compliance.

4. Customer’s Responsibilities. In addition to compliance with the Terms of Service and the Order Form, Customer shall:

4.1. be solely responsible and liable for legality of Customer Inputs and Customer Outputs;

4.2. be solely responsible and liable for compliance with third-party intellectual property rights during the use of the Service;

4.3. be solely responsible and liable for the accuracy, quality, and legality of Customer Data, the means by which Customer acquired Customer Data, Customer’s use of Customer Data with the Services, and Customer’s handling of Customer Data;

4.4. use commercially reasonable efforts to prevent unauthorized access to or use of Services, and promptly, but in no case later than 48 hours of gaining such knowledge, notify FWS of any such unauthorized access or use;

4.5. not send any personal information of children under 13 years of age (or the applicable age of digital consent). Customer shall not allow minors to use the Services;

4.6. provide true, accurate, and current information as requested by FWS at any time, and promptly and regularly update Customer’s information to maintain its accuracy and completeness; and

4.7. provide for Customer’s own access to the Internet and pay any fees or costs related to such access.

5. Prohibited Activities. Customer shall not, directly or indirectly, and Customer shall not permit any Users or any other persons to:

5.1. undertake any act or omission resulting in violation of security of personal information, or other person’s rights, including but not limited to, privacy rights;

5.2. attempt to compromise the integrity, availability, or security of Services or third party services. Customer shall not robe, scan, or test the vulnerability of any FWS system or network without explicit prior written authorization by FWS;

5.3. use the Service to create, store or transmit Malicious Code or any material in violation of third-party privacy rights or third-party intellectual property rights;

5.4. attempt to gain unauthorized access to any Service or Content or its related systems or networks is strictly prohibited;

5.5. frame or mirror any part of any Service or Content, other than framing on Customer’s own intranets or otherwise for its own internal business purposes as and only to the extent permitted in the Documentation;

5.6. sell, resell, license, sublicense, distribute, make available, rent, or lease, any Service or Content, or include any Service or Content in a service bureau or outsourcing offering;

5.7. access Services for purposes of monitoring their availability, performance, or functionality, or for any other benchmarking or competitive purposes;

5.8. use a single account on behalf of third parties, including but not limited to Customer’s clients, without prior written explicit consent from FWS;

5.9. share a single User account between multiple individuals;

5.10. modify, copy, or create derivative works based on a Service or Third-Party AI Tools, or any part, feature, function or user interface thereof;

5.11. copy or create derivative works based on Content except as permitted in the Terms of Service or in an Order Form or the Documentation;

5.12. except to the extent permitted by Applicable Law, disassemble, reverse engineer, or decompile a Service or Content or access it to (1) build a competitive product or service, (2) build a product or service using similar ideas, features, functions or graphics of the Service, (3) copy any ideas, features, functions or graphics of the Service, or (4) determine whether the Services are within the scope of any patent; and/or

5.13. attempt, permit, or undertake direct or indirect access to or use of any Services or Content in a way that circumvents a contractual usage limit, or use any Services to access or use any of FWS’s intellectual property except as permitted under the ToS or the applicable Order Form.

6. Inappropriate Content. Customer shall not, directly or indirectly, and Customer shall not permit any Users or any other persons to upload, post, provide as Customer Input, or attempt to generate or receive as Customer Output, any data, information, or content, that:

6.1. promotes spam, fraudulent activities, phishing, or malware or compromise security or gain unauthorized access to computer systems or networks, including spoofing and social engineering or violate the security, integrity, or availability of any user, network, computer or communications system, software application, or network or computing device;

6.2. undertake any act or omission during the Subscription Term resulting in impersonation, or using the Services in a manner intended to convince or deceive a natural person that they are communicating with a natural person; engage in inauthentic behavior or disinformation campaigns; targets or track person’s location, behavior or communication, generate deceptive or misleading comments or reviews; plagiarize or engage in other forms of academic dishonesty;

6.3. is infringing, libelous, obscene, threatening, harassing, hate-oriented, defamatory, racist, or otherwise objectionable, unlawful, or tortious material;

6.4. is illegal, consists of instructions to facilitate illegal actions or services, encourages or provides inputs on how to engage in illegal activities, consists of designing or marketing dangerous material, has the potential to cause harm to or loss to anyone, or is related to gambling or betting;

6.5. encourages, engages in, or is related to, in any form, self-harm, bullying, harassment, humiliation, or shaming, anyone;

6.6. incites, promotes, or actively encourages violence or terrorism, or describes, encourages, supports, or provides instructions to commit a crime against anyone on the basis of race, ethnicity, religion, nationality, gender or sexual orientation, or that may harm any individual or community.

7. Content Limitation. The Customer Inputs must not include any of the following, and must not be created in a manner that is likely to result in Customer Outputs containing any of the following:

7.1. a governmentally assigned identification number, including social security number or driver's license number or government-issued identification card number;

7.2. financial account number, or credit or debit card number, with or without any required security code, access code, personal identification number or password, that would permit access to an individual’s financial account; and/or

7.3. one or more factors specific to a person’s physical, physiological, mental, economic, cultural identity or social status.

8. Social Media, Livestreaming and Demonstrations. Posting your own Customer Inputs or Customer Outputs to social media is generally permissible, as is livestreaming your usage or demonstrating our products to groups of people. Please adhere to the following:

8.1. Manually review each Customer Output before sharing or while streaming.

8.2. Attribute the Customer Input and Customer Output to your company.

8.3. Indicate that the Customer Output is AI-generated in a way no user could reasonably miss or misunderstand.

8.4. Do not share Customer Outputs that violate this Acceptable Use Policy or that may offend others.

8.5. If taking audience requests for Customer Inputs, use good judgment; do not provide inputs that might result in violations of this Acceptable Use Policy.

9. CONSEQUENCES OF VIOLATION. In the event of violation of this Acceptable Use Policy by Customer, FWS reserves the right to terminate the Services with immediate effect by providing a written notice to the Customer or provide the Customer, in good faith, at FWS sole discretion, an opportunity to rectify the act or omission resulting in violation of Acceptable Use Policy. Customer agrees that FWS shall not be held liable or responsible for any loss or damage caused as a result of such termination. No refunds shall be provided to Customer, in the event of such termination.

10. LAW ENFORCEMENT. FWS reserves the right to report to law enforcement authorities any actions that may be illegal. When legally required or at FWS’s discretion, FWS will cooperate with law enforcement agencies in any investigation of alleged illegal activity on the Services.

11. REVIEW AND MODIFICATION. FWS reserves all rights to modify the Acceptable Use Policy at FWS sole discretion, from time to time. You shall be responsible for reviewing this Acceptable Use Policy from time to time for modifications.
